EVENT TERMS AND CONDITIONS

1. Event and Promoter
Entry into and participation in any Sanitarium™ Weet-Bix™ Kids TRYathlon Event held between 24 November 2026 to 23 March 2027 (or such other dates as the Promoter may determine) (Event) is deemed acceptance of these Terms and Conditions and the policies set out at Schedule One (Policies) by entrants and their parent or guardian, including any information on how to enter and prizes.
The events are scheduled as follows:

The promoter is New Zealand Health Association Limited trading as the Sanitarium Health Food Company, 124 Pah Road, Royal Oak, Auckland, New Zealand 1023 (Promoter). The Promoter can be contacted on: 0800 100 257. All decisions of the Promoter are final and no correspondence will be entered into.

2. Can I Enter?
Entry is open to New Zealand residents aged 6-15 years old (Eligible Entrant).

3. Parent or Guardian Approval
By registering a participant under 18 years of age, you confirm that you are their parent or legal guardian and have read and accepted these Terms and Conditions (including the Privacy Policy), the Parent/Guardian Waiver & Release and the Policies set out in Schedule One on their behalf.

4. When can I enter the Event?
Entry opens on 19th August 2026 and ends on 23rdth March 2027 (or such other dates as the Promoter determines).

5. How do I enter?
To enter the Event and be able to access the programme benefits, you must register to participate by visiting tryathlon.co.nz and following the prompts to enter your details and choose one of the entry options (fees vary based on time of registration, method of registration, number of family members, number of events and Weet-Bix Kids TRYathlon Foundation support).

6. Can I enter multiple times?
Only one entry is permitted per person, per individual event.

7. Withdrawing from an event
If you wish to withdraw from an event, you must inform the Sanitarium Weet-Bix Kids TRYathlon Customer Services Team via email on tryathlon@sanitarium.co.nz. If an Eligible Entrant withdraws before the closing date, any refund will be processed in accordance with the Event Cancellation & Refund Policy.

8. Photos
You may purchase a digital photo pack of your child during registration for the Event. By selecting and paying for a digital photo pack and accepting the Digital Photo Pack Waiver, you agree to the Supersport Images Digital Photo Pack Terms & Conditions (see Schedule One).

9. Promotion Codes
You acknowledge and understand that when using an applicable promotion code, it must be entered in the ‘Promo Code’ field when completing an online registration or in the space provided on any hard copy registration form. Promotion codes are limited to the use of one code per transaction and using a promotion code does not guarantee entry into an event. Registration details that include a promotion code must be submitted prior to the online registration closing date or before the event sells out. All discount codes expire 9.00am Tuesday 23rd March 2027.

10. Merchandise
You can place an order by following our website prompts. Orders must be from New Zealand. The Promoter reserves the right to accept or reject your order for any reason, including if the requested merchandise is not available, there is an error in the price or merchandise description on this website or an error in your order. Each accepted order shall be governed by these Terms and Conditions and the Merchandise Refund Policy (refer to Schedule One).
a. Payment: All prices are in New Zealand dollars and include GST (where applicable). Payment must be via debit or credit card (Visa or Mastercard). You will charged during the purchasing process and prior to delivery. If payment cannot be processed, the order may be cancelled.
b. Delivery: Merchandise will be delivered to the New Zealand address nominated by you at the time of purchase. Delivery times are estimates only and delivery fees (if any) will be disclosed at the time of purchase. Risk in the merchandise passes to you on delivery, including where the merchandise is left unattended at the nominated address.
c. Event Collection: If you select a collection option, merchandise must be collected from the location and within the timeframe advised by the Promoter. Uncollected merchandise will be dealt with in accordance with the Merchandise Refund Policy.
d. Incorrect Iron-on Letters: If you receive incorrect iron-on letters please contact the Promoter as soon as possible. Replacement letters may be provided in accordance with the Merchandise Refund Policy.
e. Changing or cancelling orders: Orders cannot be changed or cancelled once submitted, except as set out in the Merchandise Refund Policy or required by law.
f. Out of stocks and substitution: If any merchandise item is unavailable, the Promoter may provide a substitute item, offer a refund, or otherwise address the issue in accordance with the Merchandise Refund Policy.
g. Returns and refunds
i. Refunds, returns and exchanges of merchandise are subject to the Merchandise Refund Policy. If exchanges are available, requests must be made within two weeks of purchase and may be accommodated subject to stock availability, event timing and postage costs. Merchandise must be returned in its original condition (including tags attached and unused) in accordance with the instructions provided.
ii. If you receive damaged merchandise, you may be entitled to a refund, replacement or other remedy in accordance with the Refund Policy. To make a claim, please email a clear photograph of the damaged merchandise to TRYathlon@sanitarium.co.nz or call 0800 WEETBIX, and retain the damaged merchandise until advised otherwise.
h. Personal use only: Merchandise is for personal use only and must not be purchased for resale without the Promoter’s prior written consent.
i. New Zealand Consumer Law: Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available to you under applicable consumer protection laws.

11. Event Alteration and Cancellation
If any event is altered (including but not limited to, a change in date, location or change in format to a duathlon, aquathon or fun run event) or cancelled, notification will be given as soon as reasonably practicable, and prior to 6:30am on the day of the event. Notification will be given over the public address system (where safe to do so), posted on the Weet-Bix brand and Event social media and communicated via email to the address given during registration for the Event. If an event is cancelled (and not postponed or otherwise modified), any refunds will be administered in accordance with the Event Cancellation & Refund Policy and Wet Weather and Cancellation Policy, with further details regarding available options and timing to be communicated to Eligible Entrants at the relevant time. If an Event is altered (including a change to the date, location, distance, course, schedule, activities or format of the Event, including conversion to a duathlon, aquathlon, fun run or shortened event), the Event will be deemed to have proceeded and, to the maximum extent permitted by law, entrants will not be entitled to a full, partial or pro-rata refund solely as a result of those changes.

12. Social media terms
If you have any questions or comments about the Event, please direct them to the Promoter (contact details below), not any relevant social media platform. The Event is in no way sponsored by, endorsed or administered by any social media platform including Facebook, Instagram, Twitter or TikTok and entrants release all relevant social media platforms from any and all liability and agree to comply with any of their applicable terms of use.

13. Promoter’s Rights
The Promoter reserves the right to:
a. disallow entries in its absolute discretion;
b. verify the validity of entries and determine the eligibility of entrants (including an entrant’s identity) and to disqualify any entry or refuse to allow Event participation or award a prize where dishonest or misleading details have been given by an entrant, or where an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions or the spirit of the Event; and
c. enforce any of its rights at any stage and failure to do so does not constitute a waiver of those rights.

14. NZ Consumer Law
Nothing in these Terms and Conditions exclude, limit or modify the application of the New Zealand Consumer Law or any other applicable laws, or the exercise of any rights or remedies conferred by the New Zealand Consumer Law or other applicable laws where to do so would contravene the New Zealand Consumer Law or other applicable laws.

15. Privacy and Personal information
a. The Promoter will collect, use and disclose your personal information and your child’s personal information in accordance with these Terms and Conditions and the Sanitarium Privacy Policy (available
at https://www.sanitarium.com/nz/corporate/privacy) and the TRYathlon Privacy Policy (available at https://tryathlon.co.nz/privacy-policy/).
b. Your, and your child’s, personal information may be used to:
iii. register, administer and improve the Event;
iv. facilitate medical assistance and related communications where required; v. provide merchandise and process payments or donations; and
vi. carry out other purposes described in these Terms and Conditions and the applicable privacy policies.
c. Unless you advise otherwise, you consent to the Promoter using the contact details below:
i. your child’s personal details including first name, and also image and photograph before, during or after the Event, for promotional, marketing, broadcasting, reporting or surveying purposes in any media worldwide, including but not limited to, for the purpose of promoting the Promoter’s current and future events held in Australia and New Zealand; and
ii. to Super Sports Images including my child’s photograph and details on their website.

The Promoter may engage third-party service providers, including Race Roster and Supersport Images, to assist with Event registration, payment processing, fundraising, merchandise fulfilment and related event administration. Personal information may be shared with these organisations and other service providers for those purposes in accordance with the Sanitarium Privacy Policy, the TRYathlon Privacy Policy and, where applicable, the Race Roster Privacy Policy (available at https://raceroster.com/legal/privacy policy).

By registering and participating in the Event, you acknowledge and agree to the following policies (as updated upon notice by the Promoter from time to time). In the event of any conflict or inconsistency, the Terms and Conditions shall prevail.
