Evo Cycles “Game of Chance” 2025/26 Promotion

TERMS AND CONDITIONS

1.        Promotion Entry into and participation in the promotion identified at Item 1 of the Schedule (‘Promotion’) is deemed acceptance of these Terms and Conditions, including the School Group Accounts Terms and Conditions identified at Item 2 of the Schedule and any information on how to enter and the prizes.
2.        Can I Enter? Entry is open to persons identified at Item 3 of the Schedule, aged in accordance with Item 4 of the Schedule. Entrants under the age of 18 must have parent or legal guardian approval to enter.

You are not eligible to enter if you are a director, officer, employee, contractor or agent of the Promotor or member of the immediate family of an employee of the Promoter, or its related corporations or agencies, businesses involved in determination of winner/s for the Promotion, businesses involved in the management of the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers (including prize suppliers), subsidiary companies/businesses and associated companies and agencies or any other person required by law to be ineligible to enter.

“Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.”

3.        When can I enter? The Promotion commences on the date and time identified at Item 5 of the Schedule and ends on the date and time identified at Item 6 of the Schedule (the ‘Promotional Period’).
4.        How do I enter? To enter the Promotion and be eligible to win, you must comply with the instructions set out at Item 7 of the Schedule during the Promotional Period (‘Entry’).
5.        Multiple entries The number of entries permitted per person for this Promotion is as specified at Item 7A of the Schedule. Unless otherwise stated, entries must be submitted separately and comply in all respects with the entry requirements set out in these Terms and Conditions. Where multiple entries are received, the first valid entry submitted will be entered into the promotion.
6.        Prize(s) The prize(s) to be won in this promotion are detailed at Item 8 of the Schedule.

The total prize pool value is up to the amount identified at Item 9 of the Schedule. The Promoter may provide an alternative prize of equal value in the event that all or part of a prize becomes unavailable for any reason beyond the Promoter’s control, to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority. Prizes, or any unused portion of any Prize, are not transferable, exchangeable and cannot be taken as cash unless otherwise specified.

7.        Prize conditions Any additional conditions applying to the awarding or redemption of the Prize are as specified at Item 9A of the Schedule.
8.        Winner selection The winner(s) of the Prize(s) will be selected from all valid entries on the date and at the location identified at Item 10 of the Schedule. The winner(s) will be the first valid entry randomly drawn from all eligible entries, using a pre-determined prize winning ratio by a computerised system. The Promotion is a game of chance.

If an entrant is under the age of 18, a prize is to be received by a person under the age of 18, the prize may be awarded to the winner’s parent or guardian and where applicable for prize fulfilment, a nominated parent/guardian must accompany any person under 18 years of age.

9.        Winner notification Winners will be notified on or before two business days from the date of winner selection. Any physical Prizes will need to be collected by the winner from the physical store of Evo Cycles (Napier and Palmerston North).
10.     Unclaimed Prizes If a Prize remains unclaimed by the date identified at Item 11 of the Schedule an unclaimed prize draw will take place on the date and at the location identified at Item 12 of the Schedule, subject to any directions from a regulatory authority. The winner, if any, will be notified in writing within seven (7) days of the unclaimed prize draw.

Subject to any unclaimed prize draw, if a winner is unavailable, unable or unwilling to take or redeem a Prize (or part of a Prize) for any reason within the timeframe stipulated by the Promoter (or if no timeframe is specified, within a reasonable time), then the Prize will be forfeited and the Promoter (and the prize supplier) are not obliged to substitute the prize.

11.     Your Warranties By submitting an Entry, you confirm and warrant that all information you provide is true, accurate and complete. If you upload or submit a photo, written response or other material, you also confirm that:

1.      you created the material yourself, it is your original work, and it has not been previously published or made publicly available;

2.      you hold all necessary rights, consents and permissions for the Promoter to use the material as described in these Terms and Conditions;

3.      your Entry does not infringe the intellectual property, privacy or other rights of any third party; and

4.      the Promoter may choose, at its discretion, whether or not to use, publish or communicate your Entry in connection with the Promotion.

12.     Use of Entries and Participation in Promotion Activities By submitting an Entry, you grant the Promoter a nonexclusive, royalty free licence to use, reproduce, publish and communicate your Entry, and any material you provide in relation to the Promotion, for the purposes of administering, promoting or reporting on the Promotion and for the purposes of publicising the Promotion, the Promotor’s business and its goods and services. This licence applies worldwide for the duration reasonably required for those purposes.

If you are selected as a winner, you agree to participate in and cooperate with reasonable marketing and promotional activities related to the Promotion, which may include being photographed, filmed, recorded or interviewed. You acknowledge that the Promoter may use such promotional material for the purposes of publicising the Promotion, the Promotor’s business and its goods and services, without further reference or additional compensation to you, unless required by law.

You consent to your Entry being reasonably edited, adapted or modified by the Promoter for formatting or presentation purposes, provided that such changes do not materially alter the substance of your Entry.

13.     Cost of Entry You are responsible for any costs associated with entering the Promotion including associated with accessing the internet. The Promoter is not responsible for any problems with communications networks and use of mechanical or electronic tools that allow for repeated entries is not permitted.

You are responsible for any costs associated with entering the Promotion, including any internet or data charges. The Promoter is not responsible for technical issues of any kind, including problems with communications networks, internet connectivity or mobile services, that may affect your ability to enter the Promotion. Use of automated, mechanical, electronic or other tools or methods that interfere with the conduct of the Promotion, are designed to generate multiple entries, or are inconsistent with these Terms and Conditions are not permitted.

14.     Submission Neither the Promoter nor any other entity associated with this Promotion is responsible for any late, lost, misdirected, corrupted, incomplete or incorrectly submitted entries. Entries are deemed to be received when they are recorded by the Promoter or its authorised agent, not at the time of transmission by the entrant.
15.     Social media terms If you have any questions or comments about the Promotion, please direct them to the Promoter (contact details below), not any relevant social media platform. The Promotion is in no way sponsored by, endorsed or administered by any social media platform including Facebook, Instagram, Twitter or TikTok and entrants release all relevant social media platform from any and all liability and agree to comply with any of their applicable terms of use.
16.     Promoter’s Rights In addition to any other legal right available to it, and subject to relevant laws, the Promoter reserves the right to:

1.      All decisions of the Promoter are final and no correspondence will be entered into;

2.      Disallow entries: subject to relevant State and Territory laws, the Promoter may, acting reasonably, disallow entries in its discretion, including (but not limited to) any entry that it considers to be unlawful, invalid, incomplete, incorrect, misleading, fraudulent, tampered with, manipulated, generated through automated or artificial means, inconsistent with these Terms and Conditions, inconsistent with the spirit or intended fairness of the Promotion, or otherwise submitted in a manner that may compromise the proper conduct or integrity of the Promotion. The Promoter may also disallow entries where the entrant has previously engaged in conduct in this Promotion or in any other promotion run in connection with the Promoter that was unlawful, fraudulent, dishonest, misleading, noncompliant with applicable terms and conditions, or otherwise contrary to the fairness or intended spirit of that promotion;

3.      Validate entries and eligibility: verify the authenticity and completeness of any entry and confirm the eligibility of entrants (including identity, age and place of residence). The Promoter may determine that an entry is invalid, or refuse to award a prize, where an entrant provides false or misleading information, engages in fraudulent, dishonest or improper conduct, or otherwise fails to comply with these Terms and Conditions or the spirit of the Promotion;

4.      Resolve identity disputes: if there is a genuine dispute about the identity of an entrant or winner, the Promoter may determine the identity of the entrant or winner using reasonable evidence;

5.      Modify, suspend or cancel the Promotion: subject to applicable State/Territory laws, amend any aspect of the Promotion (including the prize), or suspend, vary or cancel the Promotion, if it cannot be conducted as planned due to circumstances beyond the Promoter’s reasonable control, including computer viruses, network failures, bugs, tampering, unauthorised intervention, technical issues or other causes;

6.      Enforce compliance: take action at any time to enforce its rights in relation to the Promotion. A failure to exercise or delay in exercising any right does not constitute a waiver of that right;

7.      Address noncompliance: disqualify an entry or an entrant where the entrant has not complied with these Terms and Conditions;

8.      If a dispute arises concerning the conduct of the Promotion or the claiming of a prize, the Promoter will seek to resolve the dispute in good faith through direct consultation with the respective entrant or winner. If the dispute cannot be resolved, the Promoter’s decision will be final; and

9.      The Promoter may, acting reasonably, verify School Group eligibility, participant numbers and school roll information and determine whether a School Group meets the Entry Requirements.

10.     Liability The prize is provided “as is”, and the Promoter makes no representations or warranties about its condition, fitness for purpose, safety, or whether it is in working order. The Winner is responsible for installation, compliance with all laws and standards, ongoing maintenance, operator training, and safe use. Title and risk pass to the winner on delivery.

To the extent permitted by law, the Promoter is not liable for any loss, damage or injury of any kind (including but not limited to indirect or consequential loss such as loss of profit, revenue or business) or expense, damage, death or for personal injury or property damage suffered or sustained in connection with participation in the Promotion or the acceptance or use of any prize, except for any liability that cannot be excluded by law. This includes any tax liability or tax implications arising from the prize. Entrants are responsible for obtaining their own independent legal and financial advice regarding any tax consequences associated with winning or accepting a prize.

11.     Third-Party Prizes If a prize is supplied by a third party, it is subject to the terms and conditions of that prize supplier. In the event of any inconsistency between these Terms and Conditions and the prize supplier’s terms, the prize supplier’s terms will apply to the extent of the inconsistency. To the extent permitted by law, the Promoter is not responsible for any delay or failure by a third-party supplier to deliver the prize, for the prize itself, or for any failure by the third-party supplier to meet its obligations.
12.     Privacy The personal information collected from entrants is required for the Promoter to conduct the Promotion in accordance with these Terms and Conditions (including any publicity associated with the Promotion), to administer the prize and, if the entrant consents, to send additional information or marketing material about the Promoter and its goods and services, including by electronic communication, in accordance with the Sanitarium Privacy Policy available at www.sanitarium.com/au/corporate/privacy/. The Promoter may disclose entrants’ personal information to third parties who assist in conducting the Promotion, including contractors, agents, service providers, prize suppliers and relevant State and Territory authorities. All personal information will be handled in accordance with the Sanitarium Privacy Policy. A request to access, update or correct any personal information should be directed to the Promoter at their address below.
13.     Consumer Law Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties. Nothing in these Terms and Conditions limits, excludes or modifies the application of, nor any rights or remedies conferred by the consumer legislation of the relevant jurisdiction identified at Item 13 of the Schedule or any other applicable laws where such limitation, exclusion or modification would contravene those laws.
14.     Promoter The promoter is identified at Item 14 of the Schedule. All decisions of the Promoter are final and no correspondence will be entered into.
15.     Governing Laws The laws of the country identified at Item 15 of the Schedule.

2. School Group Accounts Terms and Conditions These Promotion Terms and Conditions must be read in conjunction with SANITARIUM ™ WEET-BIX™ TRYATHLON™ 2025/2026 Terms and Conditions. By registering via a School Group Account, participants agree to abide, and be bound, by these terms and conditions. To the extent of any inconsistency, the SANITARIUM ™ WEET-BIX™ TRYATHLON™ 2025/2026 Terms and Conditions prevail.

‘School Group’ means a group registered through the SANITARIUM™ WEET‑BIX™ TRYATHLON™ School Group registration process for the relevant event.

To create a School Group account, School Group Coordinators must visit https://tryathlon.co.nz/schools/create-group/  before the respective cut-off date for School Group creation for their event location, or event sell out (whichever comes first) and follow the prompts. One School Group account can be created per school, per event location.

3. Eligible Entrants Eligible entrants are School Groups registered in New Zealand for the SANITARIUM™ WEET‑BIX™ TRYATHLON™ 2025/2026 that meet the Entry Requirements set out in this Schedule. Entries are submitted on behalf of the School Group by the School Group Coordinator.
4. Eligibility Age Aged between 6 and 15 years of age
5. Promotion Period commences 9:00am NZST on 16 February 2026
6. Promotion Period ends 11:59pm NZST on 3 March 2026
7. Entry requirements To enter the Promotion, a school must register as a School Group for the SANITARIUM™ WEET‑BIX™ TRYATHLON™ 2025/2026 and meet the requirements below.

 

Each eligible School Group will receive one (1) entry into the Evo Cycles Prize Draw for the Hastings and Palmerston North events.

 

A School Group will be eligible if, by the earlier of the relevant event cut‑off date for participant entry or when the event sells out:

(a)    the School Group has:

  1. 15 or more participants entered; or
  2. 10 or more participants entered if the school has a school roll of 51–100 students; or
  3. 5 or more participants entered if the school has a school roll of 50 students or fewer; and

(b)    all participants entered in the School Group are aged between 6 and 15 years.

 

Participants may be entered:

(a)    directly into the School Group by the School Group Coordinator; or

(b)    by registering individually in accordance with the SANITARIUM ™ WEET-BIX™ TRYATHLON™ 2025/2026 Terms and Conditions and being validly linked to the relevant School Group.

 

School roll numbers will be determined by reference to the Ministry of Education Directory of Schools as at the applicable School Group cut‑off date for the relevant event.

7A. Multiple Entries Each eligible School Group will receive one (1) entry into the Prize Draw only, regardless of the number of participants entered above the minimum eligibility threshold.
8. Prizes There are six (6) prizes to be won in total during the Promotion, each prize consisting of one (1) Evo Rocker 24” Kids Bike, with Prizes allocated as follows:

(a)    Hastings School Group is eligible to win a maximum of three (3) Prizes; and

(b)    Palmerston North School Group is eligible to win a maximum of (3) Prizes.

9. Prize Pool NZD $3,300
9A. Prize Conditions The Winner must claim their prize in accordance with the instructions which the Promoter will send to the Winner by email.
