TERMS AND CONDITIONS
- The Promotion is the ‘WIN a signed 2024 All Blacks™ Jersey Giveaway 2025’ promotion (Promotion). The signed All Blacks™ jersey is one of many spot prizes awarded randomly at the TRYathlon Prize Giving. All registered participants as of the closing date (9am 12th February 2025) are eligible to win.
- Information on how to enter and the prizes form part of these terms and conditions (Terms and Conditions). Participation in this Promotion including entering this Promotion or collecting or accepting the Prize the subject of this Promotion is deemed acceptance of these Terms and Conditions.
- New Zealand Health Association Limited trading as Sanitarium Health Food Company is the promoter of this Promotion (Promoter).
- Entry is only open to New Zealand residents.
- Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion (or collecting or accepting the Prize the subject of this Promotion).
- Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- This Promotion commences on Thursday 6th February 2025 upon sending of the email advertising the Promotion (Promotional Email) and social media post and entries close at 9am NZST on Wednesday 12th February 2025 (Promotional Period).
- All registered participants of the 2025 Hastings Sanitarium Weet-Bix Kids TRYathlon as of the closing date (12th February 2025) are automatically entered into the draw for this prize. This prize is one of the many spot prizes that will be randomly awarded at the official Prize Giving ceremony.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. The Winner (or if the Winner is under 18 years of age their parent or guardian on their behalf) must upon request supply suitable identification at the time that the Promoter delivers the Prize.
- One entry is permitted per person and in accordance with the requirements set out in clause 8 and these Terms and Conditions. If there is a dispute concerning the conduct of this Promotion, the Promoter will consider the entrant’s grievances however reserves the right to resolve the dispute in the manner it determines most appropriate, acting reasonably.
- The draw will take place in the Event Village at the Hastings Weet-Bix Kids TRYathlon at approximately 12pm on Wednesday 12th February at Mitre 10 Park, 42 Percival Road, Hastings. The Winner must be present at the Prize Giving to claim their prize. If the Winner is not present, the prize will be redrawn at the same event until an eligible Winner is found.
If the event is cancelled or postponed, alternative arrangements will be made for the draw. - Subject to clause 11, the Promoter’s decision is final, and no correspondence will be entered into.
- The Prizes awarded in this Promotion are:
1. A signed 2024 All Blacks™ Jersey (one winner, selected at Prize Giving) There are no bonus prizes awarded as part of this Promotion. - If the Winner of the Prize is under the age of 18 years, the Prize will be awarded to the Winner’s nominated parent or guardian on the Winner’s behalf.
- If for any reason a Winner does not take or claim the Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited and the Promoter may offer the Prize (or that element of the Prize) to a Runner Up.
- Prizes are non-transferable and cannot be exchanged for cash. If a prize becomes unavailable, the Promoter reserves the right to substitute it with a prize of equal or greater value.
- Entrants consent to the Promoter using their name, in the event they are the Winner in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel this promotion, as appropriate.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees. The Promoter is not responsible for any loss, damage, or injury resulting from participation in this promotion, except where required by law
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
- any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
- any theft, unauthorised access or third party interference;
- any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
- any variation in prize value to that stated in these Terms and Conditions;
- any tax liability incurred by the Winner or entrant; or
- use of the Prize.
- The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities, and may also use and handle personal information as set out in its privacy policy. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
